India Design

The Indian Design system is based on the Indian Design Act of 2000, which came into effect in 2001. Design registrations can be granted for products based on their aesthetic value.

The process of design registration is very simple and the design registration is typically granted within six to twelve months of filing. It is advisable to conduct a comprehensive design search before proceeding with design registrations in India to avoid any infringement or objections later.

Design registrations in India can be filed through a patent attorney, or through agents called design facilitators. The government fees for filing design applications in India vary, depending on whether the applicant is an individual or a company. The list of forms required during the entire design prosecution in India can be found at https://ipindia.gov.in/form.htm
