UK Design Application

Design registration is a powerful tool for safeguarding the unique look of your product, whether it’s the shape, pattern, or configuration. By registering a design, you make it easier to legally establish ownership and prove the creation date, which is essential if someone attempts to copy or use your design without authorization.

Benefits of Registering Your Design

Registering your design provides key legal advantages:

  1. Establish Ownership: Design registration gives you documented proof that the design belongs to you.
  2. Date of Creation: It records the creation date, which can be critical in disputes over originality and ownership.

Duration of Design Protection

A design registration offers protection for 5 years from the date of registration. To maintain this protection, renew your registration every 5 years, with a total possible duration of 25 years.

Eligible Designs for Registration

To qualify for registration, your design must be new and apply to one or more of the following elements:

Physical Shape: The form and contour of the design.
Configuration: How parts of the design are arranged together.
Decoration or Color: Visual elements, colors, or patterns.
Pattern: The specific motif or design that distinguishes the product.

Designs That Cannot Be Registered

Certain types of designs are not eligible for registration. You cannot register:

Offensive Content: Designs that include vulgar or pornographic content.
Protected Symbols: Designs using national flags, official emblems, or hallmarks like the Olympic rings without permission.
Functional Aspects: Elements of a design that are purely functional, like mechanisms that enhance performance (e.g., a chair with unique folding speed).

By ensuring your design is eligible and properly registered, you strengthen its protection and gain exclusive rights that help preserve its originality for years to come.
